Consignor Agreement

This consignment agreement is made between you the "Consignor" and REplay Sports Atlanta

IT IS AGREED AS FOLLOWS:

1. Consignor agrees to allow REplay Sports Atlanta to sell any or all items checked in to a REplay Sports Atlanta Consignment Event. The Consignor is responsible for tagging each item and setting the selling price. A "ND" on the tag will indicate the item is not to be discounted at the Half-Off sale.
2. REplay Sports Atlanta agrees to pay Consignor 70% of the total sales amount for his items. Consignor understands that an additional five dollar ($5) administrative fee is deducted from his share.  REplay Sports Atlanta will mail checks within 14 days from the conclusion of the sale. Consignor agrees that he will cash his REplay Sports Atlanta proceeds check within 90 days of check issue date.
3. By appearing in a public venue as a shopper, consignor or volunteer, REplay Sports Atlanta has Consignor’s permission to use his image(s) in any REplay Sports Atlanta publicity avenue they choose.
4. Consignor gives consent to REplay Sports Atlanta, to act on his behalf in donating any items that are not picked up by the end of the designated pick-up period to a non-profit charity.  The pick-up period can be found on the website at REplay Sports Atlanta.com or in the current REplay Sports Atlanta Flyer.
5. REplay Sports Atlanta provides the consignor a tax donation form for Consignor’s personal records, if Consignor so desires.
6. Consignor agrees to waive, hold harmless and make no claim against REplay Sports Atlanta, the lessor of the space where the sale is held, any volunteer or paid participants in the sale, or the insurer of REplay Sports Atlanta for either of the following: (a) any damage, theft or loss of any items consigned to REplay Sports Atlanta. Consignor assumes the risks of these events occurring by participating in the sale; and (b) any and all claims for personal injury resulting from participation in the sale from whatever cause.
7. Each item offered for sale by the Consignor is in good operating condition with good batteries (if applicable), reasonable wear and tear expected, and is not defective, broken or damaged in any way, and not subject to recall.  Consignor confirms and agrees that he will review The Consumer Product Safety Commission's (CPSC) website within one week of the sale, http://www.cpsc.gov to ensure that the items consigned are NOT recalled or in any way in violation of current CPSC guidance.  Consignor indemnifies and holds harmless REplay Sports Atlanta from any and all claims relating to any of Consignor’s items sold at any REplay Sports Atlanta Consignment Event, including, but not limited to, claims for personal injury from such items.  This indemnification shall extend to any and all expenses and losses incurred by REplay Sports Atlanta resulting from the defense of such claims, including reasonable attorneys’ fees.
8. This agreement will remain in force for any future REplay Sports Atlanta sales unless cancelled in writing by either party and delivered to the other party. This agreement replaces any other previous agreements in effect.

WE CERTIFY THAT WE HAVE READ AND UNDERSTAND THIS AGREEMENT AND AGREE TO ABIDE BY ITS TERMS. CHECKING THE BOX BELOW ELECTRONICALLY SIGNIFYS MY AGREEMENT TO THESE TERMS.
